The California jury deliberated for six days before awarding $40.3 million to Nancy Cabibi, a 71-year-old woman who was diagnosed with mesothelioma in 2017.
According to court papers, experts found tremolite and anthophylite asbestos in her body tissues. Both types of asbestos are known contaminants of Johnson’s Baby Powder and Shower to Shower.
Johnson & Johnson’s lawyers argued that she was exposed to asbestos while living in an industrial part of Los Angeles. However, she never entered any facilities where she may have been exposed.
The jury agreed that Johnson’s Baby Powder was defective because it contained asbestos. Furthermore, the jury found that asbestos-tainted talcum powder likely caused her to develop mesothelioma.
Johnson & Johnson has been hit with several multi-million dollar jury verdicts in favor of people who were diagnosed with mesothelioma after breathing asbestos from talcum powder products.
Last month, a New Jersey state jury slammed the company with a $37.3 million verdict in favor of four people who were diagnosed with mesothelioma after using Johnson’s Baby Powder.
The lawsuit was filed in the Superior Court of the State of California, County of Los Angeles — In RE: Nancy Cabibi et al. v. Avon Products Inc. et al. — Case number BC665257.
